A同學(xué)于2021高中畢業(yè)，成績(jī)優(yōu)異，其有意愿去美國(guó)留學(xué)。于是他通過(guò)在網(wǎng)上尋找留學(xué)代理機(jī)構(gòu)找到位于北京的B教育咨詢公司，通過(guò)閱讀其公眾號(hào)的文章，其大量廣告內(nèi)容顯示可以申請(qǐng)到美國(guó)前30名的名校，和A同學(xué)想要申請(qǐng)美國(guó)西北大學(xué)的需求相符。故雙方簽署協(xié)議后，A同學(xué)支付了36萬(wàn)余元作為咨詢費(fèi)。此后，B公司開始為A同學(xué)申請(qǐng)學(xué)校，隨后告知已經(jīng)為其申請(qǐng)到了西北大學(xué)，但在A同學(xué)拿到offer注冊(cè)學(xué)生身份時(shí)才發(fā)現(xiàn)B公司為自己審理了西北大學(xué)SPS 學(xué)院，該課程是為美國(guó)在職專業(yè)人士設(shè)計(jì)的兼職課程。B公司構(gòu)成根本違約，此后，A同學(xué)向B公司要求退款，B公司認(rèn)為其完成合同無(wú)法退款，雙方發(fā)生糾紛。雙方將爭(zhēng)議訴至北海國(guó)際仲裁院經(jīng)過(guò)審理，案涉《高端留學(xué)服務(wù)項(xiàng)目協(xié)議》已因B公司根本違約被解除，B公司向A同學(xué)返還咨詢費(fèi)及律師費(fèi)，并承擔(dān)仲裁費(fèi)。

根據(jù)《中華人民共和國(guó)民法典》第五百零二條、第五百六十三條、第五百六十五條、第五百六十六條的規(guī)定，仲裁庭裁決如下：
(一)確認(rèn)申請(qǐng)人A同學(xué)和被申請(qǐng)人B公司簽訂的《高端留學(xué)服務(wù)項(xiàng)目協(xié)議》于解除；
(二)被申請(qǐng)人B公司向申請(qǐng)人A同學(xué)返還咨詢費(fèi)363431元；
(三)被申請(qǐng)人B公司補(bǔ)償申請(qǐng)人A同學(xué)律師費(fèi)38000元。
In accordance with the provisions of Articles 502, 563, 565 and 566 of the Civil Code of the People's Republic of China, the arbitral tribunal ruled as follows:

仲裁庭通過(guò)審核雙方證據(jù)，認(rèn)為B公司明知A同學(xué)及其家長(zhǎng)的需求，對(duì)其要求赴美留學(xué)并申請(qǐng)到全日制的要求予以確認(rèn)，而B公司偷換概念為A同學(xué)申請(qǐng)到的成人教育學(xué)院屬于根本違約，支持了A同學(xué)的請(qǐng)求同時(shí)支持了A同學(xué)為了維權(quán)付出的律師費(fèi)。
